Terms of Service

1. General

Fox and Panda Comics (“we”, “us”, “our”) reserves the right to update these Terms at any time. Changes will take effect once published on our website.

2. Products & Availability

All products are subject to availability.

We make every effort to ensure product descriptions, images, and pricing are accurate. However:

• Images are indicative only and may vary slightly from the final product

• Errors may occur, and we reserve the right to correct them

​

If an item becomes unavailable after you place an order, we will contact you to arrange a refund or alternative.

​

3. Orders & Payments

Orders are only confirmed once payment has been successfully processed.

We accept payments via approved payment providers, including credit/debit cards and Buy Now Pay Later services. (e.g. Afterpay, PayPal)

We reserve the right to:

• Limit quantities per customer

• Cancel orders suspected of fraud or misuse

• Refuse service where reasonable

4. Pre-Orders, Back Orders & Allocations

Pre-orders and back orders are subject to supplier availability and delivery schedules.

​

Estimated release dates are estimates only and may change due to factors outside our control.

​

By placing a pre-order, you acknowledge:

• Delays can occur

• Partial shipments may be required

• Fulfilment begins once stock arrives

​

Where products are heavily allocated, orders may be adjusted or cancelled in line with supplier allocations. In such cases, affected customers will be contacted and refunded as required. In regard to Pokemon or other TCG allocations. Allocations will only be given once we have a confirmed allocation from the supplier. NO pre-orders on TCG products be in place at Fox and Panda Comics. We do not allow pre-orders of Pokemon stock or any other TCG stock.

5. Shipping & Risk

Shipping timeframes are estimates only.

​

Risk in goods passes to you once your order has been dispatched. Fox and Panda Comics is not responsible for delays caused by postal or courier services.

​

All packages will come with tracked shipping. We however are not responsible for any lost or damaged products while in transit with the postal or courier services.

​

6. Local Drop Off (if offered)

Local drop off orders must be delivered within a reasonable timeframe after notification.

Uncollected orders may be cancelled or transferred to shipping at the customer’s expense after reasonable attempts to contact the customer are unsuccessful.

 

After 30 days have passed and we have not received any communication from you, Fox and Panda Comics will consider your order abandoned and will return the items back to stock without a refund.

7. Returns & Refunds

Fox and Panda Comics complies fully with the Australian Consumer Law (ACL).

You are entitled to a repair, replacement, or refund for major faults as defined under the ACL.

​

Change-of-mind returns are not required under the ACL and are offered at our discretion, subject to:

• Item condition

• Product type (e.g. sealed trading cards, comics, statues or blind boxes)

• Time since purchase

Certain items, including sealed trading card products, may not be eligible for return once opened.

8. Trading Cards, Comics & Collectables (singles, vintage, retro or collectable memorabilia)

Trading Cards, Comics & Collectables (singles, vintage, retro or collectable memorabilia), and graded items are sold as collectible products. Minor manufacturing variations, print lines, or packaging imperfections are not considered faults. Vintage or Retro items (comics, trading cards and figures/statues) will have age and wear as it is a collector item. These descriptions are clear in the item description. Failure to read these descriptions are not considered faults.

9. Limitation of Liability

To the maximum extent permitted by law, Fox and Panda Comics is not liable for indirect, incidental, or consequential loss arising from the use of our website or products. Nothing in these Terms limits your rights under Australian Consumer Law.

10. Governing Law

These Terms are governed by the laws of Australia. Any disputes will be handled in the appropriate Australian jurisdiction.
